BOARD OF SELECTMEN
SPECIAL MEETING MINUTES


The Board of Selectman held a Special Meeting at 4:00 pm on March 13, 2017 in the Meeting Hall of the Old Lyme Memorial Town Hall. First Selectman Bonnie Reemsnyder and Selectman Skip Sibley were present. Selectwoman Mary Jo Nosal was present by speaker phone.

  • Authorizing Resolution for FFY 2016 Homeland Security Grant Program/Motion:
First Selectman Reemsnyder explained that in order to apply for the Homeland Security Grant the board needs to approve a resolution authorizing the First Selectman to sign the application. First Selectman Reemsnyder read the resolution and then explained that the funds go to the entire Regional Emergency Planning Team in Region 4. The grant, which is over $317,000, is used to provide equipment and services for all towns in the region, and each town must pass this resolution before signing the application
A motion was made by Selectman Sibley, seconded by Selectwoman Nosal, to approve the resolution as read. Motion passed.
2.   Miami Beach Clean Beach Process Discussion:

First Selectman Reemsnyder explained that the special meeting was scheduled to allow the officers of Miami Beach to update the Selectmen on their plans for the summer. Mark Mongillo, Miami Beach President, and Mark Girard, VP of Miami Beach, were invited up to speak to the Selectmen. Mark explained that the purpose of the Clean Beach pass is to provide a safe, clean and enjoyable beach for all who visit. He provided a document that described the Clean Beach Pass Program, effective May 15, 2017, which is attached to the minutes. A fee of $10 per adult, and $5 per child 10-17 yrs. of age will be charged at the gate between Sound View Beach and Miami Beach (children under 10 are free). The Lot b-11 entrance would be for only residents with seasonal passes – either from Miami Beach, Sound View Beach Association or Town of Old Lyme. First Selectwoman Reemsnyder expressed her concern with all paying customers coming in through Sound View Beach, which she previously requested would not happen. There was discussion about the possibility of having paying customers come in through Lot b-11, but they Miami Beach officers rejected that idea, as they felt that they had to consider the residents around Lot b-11. There was discussion about how this will work when there are large crowds trying to get on the beach. The officers shared their plans for the security on the beach, and handling non-compliant customers (those who are on the beach without paid wrist-bands). Instructions will be given to security to call 911 if a patron adamantly refuses to leave the beach. There was also discussion about the trash on the beach, and Miami Beach plan to issue a 13-gallon trash bag to each patron, in hopes that they will take the bag with them when they leave the beach. There was concern about garbage receptacles being filled and/or bags being left in the parking lots.
Fire Marshal Dave Roberge had some comments on the beach access to Miami Beach, and the number of patrons that could fit on both Sound View Beach (approx. 460 people based on 15 sf per person) and Miami Beach. There were also comments about emergency access at each entrance/exit. Since Miami Beach would be charging for entrance, the beach becomes a venue, just like a business place. Mark Mongillo and Mike Girard agreed to get additional information to the Fire Marshal. Frank Pappalardo, chairman of Sound View Commission and member of Sound View Beach Association, thanked the Miami Beach Association officers for bringing Sound View Beach Association into the process, and requested that a review of the process be conducted soon after busy, hot days and holidays, such as July 4th so that any issues can be addressed promptly. He also expressed hope that if behavior down at these two beaches is corrected the fence could be removed. There was further discussion about crowd control and the ability to control overcrowding on a beach with wide access to the beach.

The Selectmen thanked the Miami Beach Association officers for following up on their commitment to keep them updated on the plans for this first summer.

A motion was made by Selectman Sibley, seconded by Selectwoman Nosal, to adjourn at 5:47 pm. Motion passed.

Clean Beach Pass Program

Effective May 15, 2017

The Miami Beach Association (MBA) Clean Beach Pass (CBP) program has been instituted due to the interest of its members to provide for the stewardship of its privately-owned beach property and adjacent Long Island Sound.  In implementing this CBP program MBA aims to provide property owners, residents, abutting neighbor's and the general public an orderly, safe, clean and well maintained Beach facility to enjoy and to protect our natural resource.
In order to provide for this program, MBA will be charging a Clean Beach Fee (Fee) to all beach goers that are not MBA, Sound View Beach (SVB) or Town of Old Lyme property owners or residents.  MBA and SVB will be issued CBPs prior to the start of each beach season.  Old Lyme property owners or residents will need to provide proof of Old Lyme property ownership at time of entry onto the Beach during hours of operation.
Guidelines, for the Clean Beach Pass Program, involve but are not limited to the following:
  • Days I Hours of Operation
  • Miami Beach is open daily from 8:00 AM - 8:00 PM.
  • Fee Collection Days (2017 Schedule)
  • For the period between Thursday May 18, 2017 and Monday June 26, 2017
  • Every Thursday, Friday, Saturday, Sunday, Monday (5 days per week).
ii.     On Tuesday and Wednesday during this period no Fee will be collected.

  • For the period between Thursday June 29, 2017 and Monday August 14, 2017
  • Every weekday and weekend (7 days per week).
  • For the period between Thursday August 17, 2017 and Monday September 4, 2017
  • Every Thursday, Friday, Saturday, Sunday, Monday (5 days per week).
  • On Tuesday and Wednesday during this period no Fee will be collected.
  • Fee Collection Hours (2017 Schedule)
  • 8:00 am - 4:30 pm with exception as follows:
  • Beginning June 151
the Fee collection hours will be extended to 6:00 pm.

(i.e., 8:00 am - 6:00 pm) every Friday, Saturday, and Sunday only.

  • Fee Schedule
  • Adults 18 and over - $10/day
  • Juniors 10-17 years  - $5/day
  • Children under 10 - Free
  • Old Lyme residents - Free with valid proof of property ownership per family or group or valid CBP. All others will receive a wristband upon payment of Fee per the Schedule.
  • Access to Beach (Overview)
  • Public Entrance off Hartford Ave - Fee collection entrance
  • Old Lyme property owners and residents, including MBA and SVB property owners - No Fee with valid CBP or proof of Old Lyme residency or property
ownership (e.g., copy of property tax bill, driver's license, or other proper proof of residency).
  • All others pay the daily Fee per the schedule posted at the beach entrance off Hartford Ave.
  • Entrance off Pond Road (A.K.A. Lot-B11) - No Fee collected at this beach entrance
  • MBA property owners, residents, their family, and guests - No Fee with valid CBP.
  • SVB property owners, residents, their family, and guests - No Fee with valid CBP.
  • All others must enter at Hartford Ave beach entrance.
  • Entrance off Miami Beach Parking Lot or Walk
  • MBA property owners, residents, their family, and guests only - No Fee with valid CBP
  • All others must use either Pond Road I Lot B11 or Hartford Ave entrance as required and in compliance with criteria outlined above.
  • Security
  • Miami Beach Association will contract with a qualified independent Security company  to provide the following services:
  • Security personnel will be assigned to the beach to monitor Fee compliance during Fee Collection times:
  • Security will walk the Beach and individuals seen without a wristband that are not part of an MBA or SVB family or group displaying a CBP will be directed to the Fee booth to purchase wrist bands.
  • If the individual(s) refuse to comply, Security personnel will make attempts to resolve the issue without altercation.
  • If altercation appears imminent Security will be advised to walk-away and contact an Old Lyme Police Officer or Resident State Trooper.
  • MBA and the Security personnel fully expect that the Old Lyme Law Enforcement Officer will deal with the situation in a professional manner in accordance with Town ordinances and State statutes and to the full extent the law will permit including but not limited to breach of peace.
  • Security will be assigned to the Beach, MBA roads and MBA parking lot.
  • Security personnel will also be stationed as needed at different points on the Beach including the Fee collection booth, at the high tide line at SVB and at
Lot B-11 entrance.
  • Security or junior security will also be assigned during the Beach Season to monitor the MBA parking lot, MBA roads, and the entrance to MBA at Flagler Road and Shore Road.
  • Security and MBA property owners will not tolerate public disruptions. MBA property owners are instructed to dial 911 for any situation that may cause or lead to cause harm to person or property including any invasion of privacy (e.g., trespassing).
  • When appropriate Security personnel or Police shall contact an MBA Board member via the escalation list (to be provided as well as posted at the Fee Collection booth) and inform them of any situation on the MBA beach or property (e.g., drunkenness, lude behavior)
  • Fee Collection Process
  • MBA will enlist the services of a private contractor (Contractor) to manage the day-to­ day operations of the Fee collection process.
  • Contractor will hire any individuals needed to collect payments, record transactions, deposit collections, maintain wristbands and ensure an orderly Fee collection process.
  • Cones and signage will be set up as needed to direct and control the foot traffic and of the paying public to the MBA Fee booth off Hartford Ave.
  • The Fee collection booth will be set back approximately 30' feet onto MBA property to minimize pedestrian traffic buildup and allow adequate stacking at the booth entrance.
  • Fees and Wristbands:
  • The paying public will receive a wristband for that day upon payment of Fee along with a garbage litter bag.
  • Wristbands will be color-coded and will randomly change daily. Security will be notified of the color-code for that particular day.
  • Security will walk the Beach and individuals seen without a wristband that are not part of an MBA or SVB family or group displaying a CBP will be directed to the Fee booth to purchase wrist bands.
  • If they refuse to participate, the situation will be handled in accordance with section D (Security) above.
  • Exception:
  • Any school-sanctioned field trip to the beach by the Old Lyme School System or any group as may be approved by the MBA Board of Governors, are exempt from the Clean Beach Fee. The group, including their chaperones, will be provided a wristband, at no charge, at the Fee booth. Advanced notification is
required by emailing the MBA at info@miamibeachassociation.com indicating the name of the group, anticipated date, time and number expected.

  • Clean Beach Pass Process for Miami Beach (MBA) Property Owners
  • Distribution of two (2) Clean Beach Passes per property initially will be issued to MBA property owners.
  • If an MBA property owner owns more than one (1) property in the Association, they will be issued two (2) CBPs for each property owned.
  • Each CBP will denote the beach season year, MBA Logo, the words Clean
Beach Pass, Not Transferrab/e, and must be Clearly Displayed when on the beach. Passes will be laminated with a clip to hang from the member's beach umbrella, beach buggy, or chair.
  • One CBP will include other family members or guests on Beach at the same time.
  • To avoid loss of your CBP, it is suggested that owners do not leave them on the Beach when no one is present. The CBP is for people not beach chairs, umbrellas or blankets.
  • The CBP must be visually displayed where it can be easily spotted by Beach Security personnel.
  • MBA property owners, family and their guests will enter from the MBA parking lot through a gate at the entrance walk to the Beach.  The gate will have a digital
combination code to enter or leave the Beach. The purpose of this locked pass gate is to provide additional security. Emergency services will be provided the code for fire or emergency situations. (Note: MBA members or their guests may enter or exit from any Beach access point as long as they have their CBP.  If exiting to visit the Sound View shops via Lot B-11 or Hartford Ave please know that you will receive a waterproof hand­ stamp if you choose not to take the CBP with you.  We strongly encourage MBA members to exit via the MBA parking lot onto Pond Rd if you do not desire to have a waterproof stamp applied to your hand).

  • Clean Beach Passes will be distributed annually beginning May 15'h. All passes issued will be recorded with the CBP numbers, the name, address and signature of the person receiving the passes.
  • Clean Beach Pass Process for Sound View Beach (SVB) Property Owners
  • The Sound View Beach Association (SVBA) will be the administrator of the CBP process for SVB property owners and residents. The issuing of CBPs to SVB property owners
will be the same procedure and cost regardless of whether they belong to the SVBA or
not.
  • MBA will provide the Passes to the SVBA to distribute to the SVB property owners at a cost of $5.00 per pass.  An amount of $1.00 per pass will be returned to the SVBA for administrative costs. Numbering of the passes will be unique to SVB in order to easily identify where the pass originated.
  • The SVB property owner must show proof of ownership by presenting their driver's license, a copy of their Old Lyme property tax bill or any other identification that will verify their SVB property ownership. Once verified, the process for distributing the passes will be similar to the process used for MBA property owners.
  • Distribution of two (2) Clean Beach Passes per property initially will be issued to SVB property owners:
  • If a SVB property owner owns more than one (1) property in SVB they will be issued two (2) Clean Beach Passes for each property owned.
  • Each CBP will denote the beach season year, MBA Logo, the words Clean Beach Pass, Not Transferrable, and must be Clearly Displayed when on beach.
  • CBPs will be made from paper or card stock with a feature that would discourage attempts to duplicate. Passes will be laminated with a clip to hang from the owner's beach umbrella, beach buggy or chair.
  • One CBP will include other family members or guests on Beach at same time to avoid loss of your CBP, it is suggested that owners do not leave Beach passes on the Beach when not present. The CBP is for people not beach chairs, umbrellas or blankets.
  • The CBP must be visually displayed where beach Security personnel can easily spot it.
  • SVBA will make CBP records available for review by an MBA representative
upon request.
  • SVB property owner's family and guests may enter through any approved beach entrance (See Section C) but are encouraged to enter through the Pond Road Lot B-11 entrance to the Beach.  The gate will have a security person to check CBP's during Beach Fee collection days. The purpose of this gate is to allow SVB members convenient and fast access to the Beach. If a SVB property owner does not have a CBP or proof of Old Lyme property ownership, then they will be directed to the Hartford Avenue. Entrance.
  • If members of your party leave the beach while others remain, they can exit any approved beach entrance but are encouraged to leave and return through the Lot B-11 (Pond Road) entrance. The security guard will provide family members exiting and re­ entering the Beach during the day a waterproof stamp which will make leaving and reentering fast and convenient.
  • Please note that the MBA Parking Lot is a locked entrance and is for the exclusive use of MBA members.
  • Proof of Property Ownership if a Legal Entity
  • Any limited liability company (LLC), partnership, corporation, trust, or other government recognized form of Legal Entity whose legal name has been duly recorded on the deed
to the property located within the Town of Old Lyme, will be considered and treated as a single property owner for the purposes of receiving a CBP. However, the individual or individuals who belong to the legal entity must provide proof of their inclusion. Proof can take the form of a copy of the Legal Entity's tax bill, a copy of the deed or any other legal document which clearly indicates individual inclusion.

  • Lost or Stolen CBP (Applies to everyone)
  • A properly identified and previously issued CBP that is either lost or stolen may be replaced for a Fee of $100.00 per pass and obtained from the Treasurer of the MBA. The individual obtaining the replacement pass must provide the number of the pass that was lost or stolen so that it can be removed from the active list.  The high cost of replacement of a CBP is to discourage abuse of this privilege.
  • Clean Beach Pass Process for Old Lyme Property Owners and Residents
  • Old Lyme property owners or residents who visit the Beach may do so at no charge and may enter and leave through any approved beach entrance but encouraged to enter the Hartford Avenue entrance. The individual must show proof of residency by presenting their driver's license, a copy of their Old Lyme property tax bill or any other identification that will verify their residency.  Once verified the property owner or resident and family or guests will receive a waterproof handstamp for the day along with a garbage litter bag.
At this time, a CBP will not be provided since the assumption is they are infrequent visitors to the Beach.
  • All family members or guests accompanying an Old Lyme resident at the time of entry
will be Permitted at no charge.
  • All rules that apply to the other beach goers will apply to Old Lyme property owners, residents, their family, and guests who visit our beach.
  • Clean Beach Pass Process for SVB and MBA Renters
  • MBA and SVB Property owners who rent their cottages will need to determine how they will manage their CBP with tenants.
  • The property owner is responsible for the use and care of the CBPs.
  • Renters who use the CBPs must abide by the rules as they apply to everyone.
  • If property owners who rent do not provide the use of their CBPs then Renters will be required to use the Hartford Avenue gate and pay the daily Fee to use the beach.
  • We strongly suggest that if you, as the property owner, allow renters to use your CBPs, then you should include an additional amount into any security deposit you require due to the high cost of replacing the CBP.
  • If you use a property management or real estate company to manage your rentals, we strongly suggest you inform them of this process so they can explain it to your potential renters.
